These Terms and Conditions (“Terms”) govern your use of the services and information provided by Falconbrokercz and your access to and use of the website and related platforms. By accessing or using our services, you confirm that you have read, understood and agree to be bound by these Terms.

2. Scope of application and acceptance of the Terms

These Terms apply to your use of the website, information, tools, content, platforms and services provided by Falconbrokercz, including but not limited to the brokerage services offered through our cooperation with Interactive Brokers UK/Ireland.

By accessing or using our website, opening or maintaining an account, submitting an order or otherwise using our services, you confirm that you accept these Terms. Where you act on behalf of a legal entity, you confirm that you are duly authorised to bind such entity.

3. Nature of our services and no investment advice

Falconbrokercz provides access to trading platforms and brokerage services, mainly relating to financial instruments such as shares, options, futures and other products, in cooperation with Interactive Brokers UK/Ireland.

Unless explicitly stated otherwise, the information and services provided by Falconbrokercz do not constitute investment advice, tax advice, legal advice or any other form of personal recommendation. Any information, market commentary or analysis provided by Falconbrokercz is of a general nature only and does not take into account your individual financial situation, investment objectives or risk appetite.

You are solely responsible for your investment decisions and for obtaining independent professional advice where necessary.

4. Account opening and obligations of the client

The establishment of a trading account is subject to successful completion of the account opening process and the acceptance of your application by Falconbrokercz and Interactive Brokers UK/Ireland. We reserve the right to refuse any application without providing reasons, subject to applicable law.

In the course of the account opening process, you must provide complete, accurate and up-to-date information and documents, including personal data and information about your financial situation, investment knowledge and experience. You agree to inform us without undue delay of any changes to this information during the business relationship.

You are responsible for keeping your login and security credentials confidential, and for all activities carried out using your account. You must inform us immediately if you suspect any unauthorised use of your account or security breach.

5. Relationship with Interactive Brokers UK/Ireland

The services provided by Falconbrokercz include, among other things, facilitating the establishment of a contractual relationship between you as a client and Interactive Brokers UK/Ireland. For this purpose, Falconbrokercz collects data from you and transfers it to Interactive Brokers UK/Ireland in order to open your trading account.

Once your account has been opened, your trading relationship will also be governed by the contractual documents and terms of Interactive Brokers UK/Ireland. Falconbrokercz has no control over the internal policies, procedures and data handling of Interactive Brokers UK/Ireland. You must carefully read and accept the applicable documentation of Interactive Brokers UK/Ireland before starting to trade.

6. Use of the website and platform

You may use our website and trading platforms only for lawful purposes and in accordance with these Terms and any other applicable contractual documents. You agree not to:

  • use the website or platform in a way that violates any applicable law or regulation;
  • attempt to gain unauthorised access to our systems or those of third parties;
  • interfere with or disrupt the integrity or performance of the website, platform or related systems;
  • use any automated tools (robots, crawlers, scrapers) without our prior written consent;
  • use the website or platform for any fraudulent or abusive activities.

We may suspend or restrict access to the website or your account if we have reason to believe that there has been a breach of these Terms or of any legal obligation.

7. Orders, execution and market risks

Orders placed via the trading platform are transmitted to the market through Interactive Brokers UK/Ireland in accordance with the applicable best execution policies and rules. The execution of your orders depends on market conditions, liquidity, technical systems and other factors beyond Falconbrokercz’s control.

Trading in financial instruments involves substantial risks, including the risk of loss of capital. Past performance is not a reliable indicator of future results. The value of investments can fall as well as rise, and you may not recover the amount originally invested.

Before trading, you should carefully consider whether such investments are suitable for you in light of your financial situation, experience and objectives. You acknowledge that you understand and accept the risks associated with trading in financial instruments.

8. Fees, charges and taxes

You agree to pay all fees, commissions, charges and other costs associated with the use of our services and your trading activities. Information on applicable fees and charges is provided separately and may be updated from time to time.

You are solely responsible for any taxes, duties or other levies arising in connection with your account, your trading activities or income generated through our services. Falconbrokercz does not provide tax advice and cannot guarantee the tax treatment of any transaction.

9. Liability and limitation of liability

Falconbrokercz will exercise due care in providing its services. However, Falconbrokercz does not guarantee that the website, platforms or services will be available without interruption or error, or that they will always be free from viruses, technical problems or other defects.

To the extent permitted by applicable law, Falconbrokercz shall not be liable for:

  • losses or damages arising out of market movements, investment decisions or trading risks;
  • indirect or consequential losses, including loss of profit, loss of opportunity or loss of data;
  • losses resulting from force majeure events, including but not limited to natural disasters, strikes, wars, acts of terrorism, power outages, failures of communication systems or other circumstances beyond our reasonable control;
  • losses caused by third-party providers, including Interactive Brokers UK/Ireland, unless required by mandatory law.

Nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

10. Intellectual property

All content and materials provided on the website and platforms, including but not limited to text, graphics, logos, icons, images, software and design, are owned or licensed by Falconbrokercz or its licensors and are protected by copyright, trademark and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable right to use the website and platform for your personal, non-commercial purposes.   • suspicion of fraud, money laundering, terrorist financing or other unlawful activities;
  • failure to provide required information or documentation, or provision of incorrect information;
  • legal, regulatory or supervisory requirements that necessitate such measures.

If you have any questions or complaints regarding our services, you can contact us using the contact details above. We will handle complaints promptly and in accordance with internal procedures and applicable regulations.

You may also have the right to submit a complaint to the competent supervisory authority or to use out-of-court dispute resolution mechanisms, where available under applicable law.

14. Changes to these Terms and applicable law

Falconbrokercz may amend these Terms from time to time, for example to take into account changes in services, legal requirements or market conditions. Updated versions of the Terms will be published on our website, indicating the date of the last update.

If you continue to use our services after the updated Terms have been published, you will be deemed to have accepted the changes. If you do not agree with the amended Terms, you must stop using our services and may terminate the relationship.

These Terms and any disputes arising out of or in connection with them are governed by the laws applicable to Falconbrokercz B.V. in the Netherlands, unless mandatory consumer protection rules of your country of residence provide otherwise.
